LIMITED WARRANTY STATEMENT (KlearKase for Kindle 3)

KLEARKASE LLC’S WARRANTY OBLIGATIONS

ARE LIMITED TO THE TERMS SET FORTH BELOW

Please note that KlearKase, LLC (“KlearKase”) reserves the right to update, from time to time, the warranty terms provided for new purchases of KlearKase products. Please refer to www.klearkase.com/warranty for the current form of Limited Warranty Statement.

KlearKase warrants to the purchaser (“you”) that new KlearKase products (“Products”) will be free from defects in material and workmanship for a period of one year from the date of purchase.  The start of the warranty period is the documented date of your original purchase of the Product.  This warranty is made to and for the benefit of the original purchaser of the Product and is non-transferable.

If you discover a defect in material or workmanship during the warranty period, and KlearKase agrees that the defect exists, KlearKase will, at its option, repair or replace the Product at no charge to you, provided the Product is returned during the warranty period with transportation charges prepaid, to the facility designated by KlearKase.  KlearKase may require proper proof of purchase prior to issuing the replacement Product.  A replacement Product may, at KlearKase’s option, include an equal or better model.  The warranty period for replacement Products is the rest of the warranty on the original Product or thirty days, whichever is longer.

This warranty does not cover any of the following conditions: (1) abuse, unreasonable use, or misuse, including submersion under water; (2) unusual physical stress; (3) damage caused by modification or repair not made or authorized by KlearKase; or (4) use of the Product not in accordance with the KlearKase Use Instructions provided with the Product.

THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE, NON-TRANSFERABLE, AND IN LIEU OF ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED.  KLEARKASE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES AS TO THE PRODUCTS OR ANY OTHER MATTER WHATSOEVER. KLEARKASE IS NOT RESPONSIBLE FOR SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED, AND WHETHER OR NOT KLEARKASE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT KLEARKASE’S MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD BY KLEARKASE SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT.

No KlearKase distributor, reseller, agent or employee is authorized to make any modification, extension or addition to this warranty. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you.
